As jurors returned to deliberations in Phil Spectorôs murder trial, his defense filed a motion asking the judge to give the panel more guidance to clarify controversial new instructions he issued last week to help break a deadlock and avoid a mistrial. In a hearing outside the jury's presence, Superior Court Judge Larry Paul Fidler listened to arguments on the motion and told attorneys he would think about it, but gave no indication how he would rule. Amid the hearing, the jury sent a note asking for a VCR. Trial evidence included a videotaped interview of Spector's chauffeur by sheriff's investigators. The driver testified that Spector came out of his house with a gun and said, "I think I killed somebody." There was also a videotape of a driveway fountain. The defense contends noises including the fountain made the quote suspect. Spector is charged with second-degree murder in the Feb. 3, 2003, death of actress Lana Clarkson from a gunshot fired in her mouth. The defense contends the shot was self-inflicted, either an accident or a suicide. After the jury reported the 7-5 impasse last week, the judge withdrew a so-called pinpoint instruction and decided that the instruction misstated the law by unduly limiting possibilities that the jury could consider. He gave a new instruction that included examples of inferences the jury could draw from the evidence, including the possibility that Spector forced Clarkson to place the gun in her own mouth and it went off. He also cautioned that he was not suggesting that any of the examples took place, and they could be rejected. In the defense motion, Spector's attorneys said that Spector would have needed a second firearm to have forced Clarkson to put the gun in her mouth. They asked that the judge tell jurors there is no evidence in the record that Spector had a second firearm present. The defense also asked that the jury be told that Spector cannot be found guilty merely for aiding, encouraging or advising Clarkson to commit suicide. The prosecution argued that any further instruction on the issue of suicide would weigh against its case. "It highlights the defense case," prosecutor Alan Jackson told the judge. "It's saying if you believe she killed herself, don't bother with any of those other instructions." The case went to the jury on Sept. 10 and the jury foreman told the judge on Sept. 18 that the panel was deadlocked after four ballots. After two days of contentious debate among attorneys on new instructions, the panel was sent back into deliberations on Sept. 20.

Kiefer Sutherland, already on probation for a 2004 drunken driving arrest, was charged with misdemeanor driving under the influence in a case the city attorney's office said could put him in jail for more than a year. "Sutherland was charged with single counts of driving under the influence and driving with a blood-alcohol level of .08 or above," said city attorney spokesman Nick Velasquez. "If convicted, he faces a maximum sentence of a year in jail and a minimum of four days,"Velasquez said. "We also charged him with a second DUI offense within 10 years, which we believe also violates the terms of his probation," Velasquez added. If found guilty of violating probation, Sutherland could be sentenced to an additional six months. Sutherland remains free on $25,000 bail. He was scheduled to be arraigned Oct. 16. "Because he's been charged with a misdemeanor, Sutherland won't have to appear in court for his arraignment unless the judge specifically orders him to be there," Velasquez said. Police said they stopped Sutherland shortly after 1 a.m. when they saw him make an illegal U-turn. He was arrested after failing a field sobriety test. Authorities haven't disclosed his blood-alcohol level except to say it was .08 or above, exceeding Californiaôs legal limit. Sutherland was also arrested for DUI in 2004, and in November of that year he pleaded no contest to one misdemeanor count. He was sentenced to Five years probation, 50 hours of community service and was ordered to attend an alcohol treatment program.

Duane Chapman, known as 'Dog the Bounty Hunter' has offered to co-sign for the bond of jailed 'Girls Gone Wild' founder Joe Francis. After watching a jail house interview with Francis and independently researching Francis' legal situation, Chapman said he thinks Francis has been mistreated by the Florida legal system and has offered to stand up for Francis in court. "I make this offer to the judge who is keeping Joe Francis behind bars," Chapman said in a statement. "I will co-sign Joe's bond, and if he violates his bail in any way; if he fools me or proves me wrong, I will personally track him down to the ends of the earth at no charge, and bring him back before the judge." Chapman's wife, Beth, who owns the bond company, has offered to write the bond, creating a double risk for the Chapmans. Francis has been behind bars, first in Florida and now in Nevada, for more than six months. Although bail has been granted in Nevada, while Francis awaits trial on federal tax evasion charges, his bond on a separate case in Florida, possession of contraband medication, has been revoked.

O.J. Simpson has pleaded not guilty to charges of kidnapping and armed robbery in relation to a sports memorabilia robbery in Las Vegas in September. Simpson and his two accomplices, Clarence Stewart and Charles Ehrlich, pleaded their innocence at the start of their criminal trial. Simpson is alleged to have stormed into collector Alfred Beardsley's hotel suite at the Palace Station in Las Vegas along with Five associates, and removed memorabilia items Simpson maintains were stolen from a storage facility. Three other co-defendants agreed to testify against Simpson as part of a plea agreement; Stewart, Ehrlich and Simpson face life imprisonment if found guilty. Beardsley and an associate claim guns were pulled during the stand-off, but the collector told the preliminary hearing earlier this month that Simpson wasn't one of the men brandishing a weapon.

Ashton Kutcher says that he had never met a gay man until he left his home town.

The 'Punk'd' star, now romancing 'Charlie's Angels' beauty Demi Moore, admitted he had never been in contact with homosexuals in his native Iowa - so he didn't realise many of his new friends were gay when he moved to New York.

He said: "When I left Iowa and went to New York for the first time it was so intense. Just the energy and the non-stop physical energy that existed. And then meeting people who were gay that I couldn't tell were gay.

"When I'd found out that someone I'd become friends with was gay, I'd be like 'Wow! I really didn't know that. I thought he was just a nice guy.'"

Despite his initial shock, Kutcher insists he didn't let his surprise spoil any of his friendships.

He added: "I always just thought, 'I'm not going to make the separation that I've been taught that I'm supposed to make.'"

Michael S. Sherry, winner of the 1988 Bancroft Prize in history, takes up this question in his insightful new book, "Gay Artists in Modern American Culture." "[W]as mid-century America really so homophobic (a term not then in use)? Perhaps, but only if homophobia is seen not as static and unidirectional, but as brimming with contradictions ... fascination, dismay, disgust, even admiration." In five thoroughly researched chapters, he shows how homophobia - if we can call it that - is not a monolithic repressive force, but a complex web of power relations that have shifted from Truman's time to Nixon's to our own. Sherry is one of the few scholars to read anti-gay rants as a strain of American conspiracy thinking, which he dubs the "homintern discourse" - a play on the Comintern (Communist International), which officially dissolved during World War II. In the late 1940s and 1950s, agitation about homosexuals in the arts stoked a "lavender scare" rivaling the red scare. Thousands of gay people were labeled "security risks" and ousted from the military, civil service and other institutions.
